1. Introduction & Acceptance

By booking or using Lucky Run Studio services, you agree to comply with and be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you (“Client”) and Lucky Run Studio (“Studio,” “we,” or “us”). Please read carefully before booking or participating in any session.

 

2. Services & Studio Operations

Lucky Run Studio provides professional audio and visual production services, including:

  • Recording, mixing, mastering

  • Audio production and arrangement

  • Photography and videography services

  • Room and equipment rental for third-party engineers

 

Studio-caused Cancellations:
If a session is canceled due to reasons within the Studio’s control (equipment failure, staff unavailability, facility issues), clients are entitled to a full refund of any deposits or prepayments.

 

Session Conduct & Responsibilities:

Arrive on time and prepared for booked sessions.

  • Maintain a professional environment; disorderly conduct, harassment, or unsafe behavior may result in session termination without refund.

  • Respect all studio property and equipment; clients are responsible for any damage caused.

  • Smoking, vaping, and open food/drink near equipment is prohibited unless approved by staff.

  • Clients under 18 must be accompanied by a parent or legal guardian.

 

3. Booking, Deposits & Payment Terms

  1. Deposits & Confirmation

    • $100 deposit per session required to confirm booking.

    • Deposits are non-refundable if canceled within 24 hours of the session, except in the case of Studio-caused cancellations, which are fully refundable.

  2. Rates

    • Rates may vary depending on day, time, and scope of work. All rates will be given by studio representative and may be subject to change as the projects progress into different stages.​​

  3. Payment

    • Payments are due upon receipt unless otherwise noted.

    • Accepted methods: credit/debit cards, ACH transfers, and approved payment links.

  4. Late Fees & Recurring Charges

    • Payments are late after 7 days; 10% late fee applied.

    • Additional 10% accrues every 30 days, up to 50% maximum.

    • Accounts more than 30 days past due may result in service suspension; past 60 days may go to collections with recovery costs charged to the client.

  5. Payment Plans

    • Offered at Studio discretion, must be approved in writing.

    • Late fees continue to apply.

    • Must be purchased with a credit card on file.

 

4. Cancellations & Rescheduling

  • Minimum 48 hours’ notice required for cancellations or rescheduling.

  • Late or no-show cancellations may forfeit deposits.

  • Full refunds apply for Studio-caused cancellations.

 

5. Data, Files, Software & Storage

  • Files retained indefinitely unless otherwise agreed.

  • Lucky Run Studio is not responsible for lost/deleted session files over one year old from last booked session.

  • After one year, Studio may delete, archive, or otherwise manage files at its discretion.

  • Clients are encouraged to maintain their own backups.

  • File retrieval may incur administrative or archival fees.

  • Software & Plugins: Any software or plugins installed on studio computers must be pre-approved by the owner or manager. Studio is not responsible for issues from unapproved installations.

 

6. Intellectual Property & Creative Contributions

  • Clients retain full ownership of all creative content not assisted, curated, or co-written by Studio staff.

  • Lucky Run and its Staff performing only technical or engineering roles are not entitled to royalties.

  • Lucky Run Studio may request royalty participation on work where staff contributed creatively (production, songwriting, arrangement, co-writing).

  • A split sheet agreement is required between artist, contributing staff, and Studio.

  • Minimum 2 points of master royalties apply only if the Studio’s specific version of the master is used.

  • No royalties, publishing splits, or sync licensing apply to other versions.

 

7. Privacy & Client Property

  • Personal information (name, email, phone) is collected for: scheduling, reminders, marketing, and billing.

  • Lucky Run Studio will not share information without client consent except to provide services or comply with law.

  • Clients are responsible for personal property (instruments, laptops, etc.) brought to the studio. Studio is not liable for loss or damage.

 

8. Limitation of Liability & Force Majeure

  • Studio is not liable for indirect, incidental, or consequential damages.

  • Liability is limited to the total cost of services rendered.

  • Studio is not liable for delays or cancellations caused by circumstances beyond our control, including natural disasters, power outages, illness, or other unforeseen events.

 

9. Dispute Resolution & Governing Law

  • Clients may submit disputes for mediation or arbitration prior to legal action.

  • These Terms are governed by Texas law. Disputes are resolved in Harris County, Texas.

 

10. Modifications

Lucky Run Studio reserves the right to modify these Terms at any time. Continued use of services constitutes acceptance of revised Terms.
